Terms of Service – CEKraemer Art
These Terms of Service apply to all galleries, photographs, digital files, prints and related photographic services provided by CEKraemer Art, Ireland.
1. Copyright and permitted use
Unless otherwise agreed in writing, all photographs and other images displayed or supplied remain the copyright of CEKraemer Art.
Customers receiving commissioned photographs are granted a personal, non-exclusive licence to download, store, print and share the images for private, non-commercial purposes.
Images may not be sold, licensed, entered into competitions, used commercially, substantially altered, edited using filters or artificial-intelligence tools, or supplied to third parties for publication without prior written permission from CEKraemer Art.
Copyright notices, signatures and watermarks must not be removed.
2. Gallery access
Gallery links, passwords and download codes are intended only for the customer and persons authorised by the customer. Customers are responsible for controlling access to their gallery.
Gallery availability is not guaranteed indefinitely. Customers should download and securely back up all purchased or supplied files before the stated gallery expiry date.
3. Image selection and editing
The photographer retains artistic discretion over image selection, composition, colour treatment and editing. Unedited files and RAW files are not supplied unless expressly agreed in writing.
The number of finished images may vary depending on the assignment, conditions and the number of usable photographs produced.
4. Downloads and digital files
Customers are responsible for ensuring that downloaded files are compatible with their devices, software and chosen printing service.
Colours, brightness and cropping may differ between screens and prints. CEKraemer Art is not responsible for the quality or colour accuracy of products produced by third-party laboratories or printers selected by the customer.
5. Orders and payment
Prices, services and products are as stated in the individual quotation, invoice, gallery or written agreement. Unless otherwise agreed, payment must be received before high-resolution files, prints or other products are released.
Any booking fee, cancellation terms, delivery schedule and additional expenses are governed by the individual written agreement for the assignment.
6. Prints and products
Customers must report visible damage, defects or incorrect items promptly after delivery and provide photographs or other reasonable evidence where requested.
Nothing in these Terms limits the customer’s statutory rights under Irish or European Union consumer law.
Personalised products and products made to the customer’s specifications may not qualify for a change-of-mind cancellation right, except where required by law.
7. Privacy and publication
Personal information and photographs are processed only for legitimate business, contractual and administrative purposes and in accordance with applicable data-protection law.
Commissioned photographs will not be used publicly for advertising, exhibitions, social media, portfolio presentation or other promotional purposes unless the customer has given permission or another lawful basis applies.
Customers who share gallery access with other people are responsible for doing so appropriately and respecting the privacy of those photographed.
8. Service interruptions and liability
Reasonable care is taken when photographing, processing, storing and delivering images. CEKraemer Art is not responsible for delays or failures caused by circumstances outside its reasonable control, including severe weather, transport disruption, illness, equipment failure, internet outages or failure of third-party gallery and delivery services.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or obligations arising under consumer law.
9. Governing law
These Terms and any related agreement are governed by the laws of Ireland. Any dispute will be subject to the jurisdiction of the Irish courts, without affecting any mandatory rights available to consumers under Irish or European Union law.
